In Gao Xiong v Public Prosecutor [2026] SGCA 26, the Court of Appeal appointed an Independent Counsel team including Harry Elias Partnership LLP Partner, Mr Sui Yi Siong, to address the Court on the appropriate approach for sentencing offences involving criminal attempts. In its judgment, the Court established a three-stage sentencing framework for criminal attempts and clarified how a sentencing discount for an incomplete offence should be calibrated, agreeing with the Independent Counsel that the discount should be expressed as a percentage. The Court also expressed its thanks to both Independent Counsel for their assistance.
