In this legal update, we examine the Brief Remarks given by the Honourable Justice Aedit Abdullah in Re Picotin Pte Ltd [2024] SGHC 156 where His Honour clarified the law under Sections 64 and 65 of the Insolvency, Restructuring and Dissolution Act 2018 (“IRDA”) in respect of corporate group restructuring (involving a holding company and its multiple subsidiaries) and the Court’s approach in balancing the proprietary interests of landlords.
