Benjamin is a Senior Associate in our specialist Construction and Engineering Practice Group.

 

Benjamin has accumulated specialised experience in construction and infrastructure, providing support across the full lifecycle of construction projects. He has represented various employers and contractors as both the Claimant and as the Respondent in a broad range of disputes in Singapore Courts and in arbitrations proceedings under many of the leading institutional rules in the region, including ICC, SIAC, and UNCITRAL rules. He also regularly handles both statutory adjudication proceedings under Singapore’s Building and Construction Industry Security of Payments Act. in a broad range of matters, including but not limited to high value commercial disputes, construction adjudications and international arbitrations under the SIAC and ICC.

 

Banjamin has also advised developers, contractors and consultants on front-end construction work, including drafting engineering, procurement and construction contracts as well as supply agreements, and executing project management strategies and assisting in contract administration, thereby adding value to the management of the infrastructure project.

Experience

  • Construction related experience
    • Represented a Singapore listed construction company in an SGD$37 million claim in arbitration proceedings relating to the construction of airport runways;
    • Represented a Singapore construction company in an SGD$8 million claim in arbitration proceedings under SIAC Rules against the main contractor in a project relating to the construction of an underground train station;
    • Drafted various agreements, including engineering, procurement and construction agreements, supply agreements and construction management agreements for various public and private projects in Singapore at various levels;
    • Represented various contractors and sub-contractors in adjudication proceedings under the Building and Construction Industry Security of Payment Act as Claimant and/or Respondent; and
    • Provided advice to various employers and contractors on contractual matters relating to delay, disruption and quantum etc in relation to their respective projects.

 

  • Commercial litigation related experience
    • Defended a Japanese listed company as the local appointed counsel in arbitration proceedings under ICC rules against a USD$91 million claim arising from the termination of a chemical sales and purchase agreement;
    • Defended a Malaysian water filtration company against an SGD$34 million claim in proceedings under the Singapore International Commercial Court arising from an attempted takeover bid; and
    • Defended a Chinese online payment platform against a USD$1 million claim concerning reimbursement in the digital payment process, including setting aside a Mareva Injunction against its local Singaporean subsidiary.
