Harry Elias Partnership LLP acted for the Respondent in a recent matter involving issues of disputed paternity and child maintenance
The Court held that it has the power to order DNA paternity testing in appropriate circumstances, but that such power should be exercised sparingly and only where there is sufficient evidence to justify compelling a person to undergo testing. The Applicant’s prayer for paternity testing was dismissed.
