For more information on the Construction, Engineering and Infrastructure Projects Practice Group, please contact Tan Chau Yee, the head of Construction, Engineering and Infrastructure Projects Practice Group at chauyee@harryelias.com.sg.

We are one of the leading construction, engineering and infrastructure projects practice group in Singapore and the region. Our experience and expertise extend to both front-end and dispute resolution work. Our clients include many established owners, contractors and consultants, both local and international.

On the front-end side, our lawyers have advised on most of the prominent projects in Singapore, including the Singapore Management University Campus, the New National Library Building, One Marina Boulevard, Business and Financial Centre and the Singapore Flyer. We are also advising the owner of one of the largest and most prominent projects in Singapore, the Marina Bay Sands Integrated Resort. The participants in this project include leading real estate developers, world renowned consultants and international contractors involving a myriad of procurement methods.

Apart from such commercial and public projects, our lawyers have advised developers in many of their residential projects in Singapore and abroad such as China and Vietnam. In addition, we have advised international owners and contractors in the procurement of their plant projects in Singapore, in particular on Jurong Island.

On the regional front, our lawyers have advised on infrastructure projects in the region, including a port project in Vietnam, a cement plant project in Malaysia and power plant projects in India and the Philippines.

In terms of dispute work, we have acted as counsel in domestic and international arbitrations and court cases between owners, contractors and consultants. These matters relate to disputes on cost and time claims, defects, enforcement of warranties, indemnities and bonds and other common construction disputes and include international arbitrations arising out of the oil and gas industry that in recent times have chosen Singapore as a forum for arbitration.

The publicly known disputes that we have been briefed include acting for a group of international project insurers in an insurance claim arising out of the Nicoll Highway collapse and acting as counsel for the joint venture owners in a major structural dispute claim arising out of a commercial building on Church Street. Our lawyers also regularly act for a number of established developers in their disputes with purchasers and management corporations.

Some of the landmark cases that we have been involved in are as follows:

  • The Practice Group has beaten its own record of having been involved in the largest and second largest adjudication claims under the Building and Construction Industry Security of Payment Act (commonly known as SOP Act).  It recently acted for and successfully defended a leading international developer against various claims in excess of SGD48 million by one of its main contractors in the largest adjudication application in Singapore under the SOP Act, which tops the second largest adjudication claim in excess of SGD17 million in which it was involved as well.

  • Acted for and successfully defended a leading international developer in relation to a SGD17.7 million claim by one of its main contractors, which represented the largest adjudication application in Singapore under the Building and Construction Industry Security of Payment Act (or commonly known as SOP Act).

  • Advised and drafted project documents (construction contracts, consultants’ agreements, supply contracts, bonds, insurances, warranties and other ancillary contracts) for the very first Integrated Resort at Marina Bay, Singapore.

  • Advised Singapore Flyer Pte Ltd on various contractual aspects of the design and construction of the Singapore Flyer, the very first and iconic architecture of Singapore and likely the largest giant observation wheel in the world.

  • Advised Singapore Health Partners on the construction of the first mediplex, comprising a hospital, hotel and medical centre in Singapore.

  • Reviewed and advised on the building contracts and collateral documentation for the development of the multi-billion dollar Marina Bay Financial Centre Project in the new downtown commercial and residential area of the Marina Boulevard area in Singapore.

  • Reviewed, advised and amended various construction contracts, incorporating a guaranteed maximum price mechanism for the multi-million One Marina Boulevard development in Singapore.

  • Advised on the letter of acceptance, conditions of contract, performance bond and other ancillary documents in respect of the Singapore Formula1 Race Pit Building Project, for the world’s first Formula 1 night race.

  • Advised the National Library Board on the development of their New National Library Building and reviewed, advised and drafted the various building contracts, consultants’ agreements, performance bonds, project insurances and product and equipment warranties required for the project.
